Acceptance of Terms and Conditions

By registering as a customer of Micronz Ltd and a user of the pureas.co.nz website you accept these terms and conditions.  Should you choose not to accept these terms and conditions, you are not permitted to use the Pureas website.

These Terms and Conditions have the following expressions and meanings: 

'Service', 'Services' means any service that is provided by Micronz Ltd;

'We' and 'Us' and 'Our' are reference to Micronz Ltd;

'You' and 'Your' are reference to users and/or browsers of the Pureas Website;

‘Pureas’ means the www.pureas.co.nz website owned by Micronz Ltd

'Website' means the Pureas website owned by Micronz Ltd;

'Product' means any product that is offered for sale and/or purchase on the Website;

'Customer', ‘Customers’ includes any person buying goods or services from Micronz Ltd and the Pureas website;

Changes to Terms and Conditions

These terms and conditions may be changed from time to time.  All changes will be effective immediately upon posting changes on the website.  It is the responsibility of all Pureas and Micronz Ltd customers to be familiar with the latest terms and conditions. Your on-going use of the Website represents your agreement to these terms and conditions.

Guarantees

If you buy a product from the website and receive a faulty product or a product different from that which you purchased, please contact us to arrange for your purchase to be returned for a full refund or credit.  No refund will be given for product returned in an unsellable condition or for product not found to be faulty on inspection of the returned goods.

Price

All prices published on the Website are in New Zealand dollars and include 15% Goods and Services Tax (GST).  Free shipping will apply to all purchases made through the Website. 

Confirmation of Order

All customers, including corporate customers, will receive an order confirmation via e-mail when placing an order through the Pureas Website.  Customers, following credit card payment, will also receive an invoice with their order. 

Payment Terms

We accept payment for purchases made through the Pureas Website via Visa and Master Card credit cards only.  All charges are made in New Zealand dollars and include GST.  We charge your credit card at the time of your purchase via the DPS secure payment system.

Product Guarantee

All products are guaranteed free of any manufacturing defects for a period of 12 months.  In the event that you experience any product issues/problems please call us first and we’ll advise of the correct measures to remedy such problems.  Our sole obligation will be to repair or replace any defective merchandise due to any manufacturing defects so long as the product has been correctly installed and complying with any Micronz Ltd recommendations.  Micronz Ltd does not warrant damage resulting from misuse, incorrect installation or improper storage.  Micronz Ltd is not liable for any incidental or consequential damage.

Delivery Policy

All goods are despatched by courier within 48 hours unless stated otherwise on the website for a particular product.  Delivery times vary from 1-5 days subject to location throughout New Zealand.  If a product ordered is out of stock and on back order, Micronz Ltd will advise the customer via e-mail on receiving their order and of the expected wait time for the product.

Return Policy

Any claims against purchases from Micronz Ltd must be made within 7 days of delivery, except where the claim is for a product manufacturing defect which products are guaranteed free of for a period of 12 months.  Prior to returning goods all customers must first contact Micronz Ltd customer service and advise the return of goods.  All returned goods must be in the original packaging, undamaged, not used and accompanied with a copy of the invoice. If you do receive a product which is faulty or different from that which you purchased, please contact us immediately to arrange return of the product.  Our qualified technician will then inspect the returned product and if found to be faulty or different from that which you purchased, you will be offered a replacement. In the event that a qualified Micronz Ltd technician finds no fault with the product, it may be returned to you at the discretion of Micronz Ltd with no refund provided.

Your Account

By registering as a user of the Pureas Website you warrant that you have provided complete, accurate and current personal or business information. You must maintain and update your information held by Micronz Ltd to ensure it is kept current at all times.  Micronz Ltd may phone or mail you to verify these details.  Without limiting any other rights or remedies we may have, you agree not to permit any other person to use your details or customer information for the purchase of goods through the Pureas Website.

We may, at our discretion, monitor your use of the Pureas Website and restrict access to any content or services available.

Emails, Newsletters and Product Reminders

Micronz Ltd may send you emails relating to products purchased, transactions and other activities on the website, and for promoting and marketing other Micronz Ltd product and services to you including new product lines or product specials on offer.  Micronz Ltd may also send regular electronic newsletters to customers.  Newsletters will contain clear and obvious instructions on how you can unsubscribe from the mailing list.  You may also receive a reminder that your filter/cartridge is due for replacement.  If you do not wish to receive these reminders, please contact us to have your name deleted from our recall/reminder list.

Indemnity

Except where we have expressly accepted responsibility to you under these Terms, you will keep us protected against any legal action taken against us and pay us any costs, losses or expenses we incur in connection with your use of our website or any failure by you to comply with these Terms.

Termination

We reserve the sole discretion, without notice, to terminate your account and ability to buy product or use our website services if we believe that you have breached these Terms and Conditions.  We may also in our sole discretion and without notice to you, stop providing some or all of the product and/or services or the Pureas Website as a whole.  Any termination by us under this term will not affect any rights or responsibilities which are intended to continue, or come into force after that time.

Intellectual Property Rights

Micronz Ltd (and Micronz Ltd suppliers as the case may be) own all proprietary and intellectual property rights on and in the Pureas Website (including text, content, graphics, logos, images, icons) and the software and architecture forming product, services and the website.  You may not without our prior written permission, in any form or by any means copy, reproduce, adapt, display, distribute, publish or create derivative works from any part of the Pureas Website; or commercialise, copy, or on-sell any information, or items obtained from any part of the Pureas Website.

Disclaimer

While the information contained in this website is accurate to the best of Micronz Ltd knowledge, it is not intended to be used to give medical or health advice.

Micronz Ltd accepts no liability for any damage to product or property in situations where water pressure exceeds 850kpa or 125psi or where Water Hammer is present and a pressure limiting device has not been installed.

General Terms

In the event of a dispute arising in relation to these Terms and Conditions, the New Zealand courts will have non-exclusive jurisdiction over such a dispute. If we do not exercise or enforce any right available to us under these Terms, this does not constitute a waiver by us of those rights. We may transfer this agreement or any benefit or obligation of this agreement to any person without notice to you.  You may not transfer any benefit or obligation to any other person without our written consent.  Each part of these Terms is separately binding.  If for any reason any part cannot be relied on, all other parts remain binding.

Privacy Act 1993

If you are an individual, you have rights under the Privacy Act 1993 to access information held by us, and to request the correction of such personal information. In respect of such personal information, you:

•             Authorise us to obtain personal information about you, via Your Registration Form and Your use of Pureas Products and Our Services.

•             Authorise us to use your personal information for direct marketing and promotional activities, research and development purposes, identity verification, and otherwise in respect of the provision of Our Services to You.

•             Agree that further notification to you of the purpose of the collection of your personal information is unnecessary and non-compliance with the requirements of Principle 3 of the Privacy Act 1993 is authorized.
